Common mistakes when buying legal services

In brief

Legal-services procurement should create a suitable professional engagement, not reduce counsel to a generic vendor promising a predetermined result. Many problems begin with unclear client identity, inconsistent instructions or a fee comparison based on different scopes. The buyer can improve selection and management while leaving legal interpretation and strategy to appropriately qualified professionals.

Selecting on confidence or a promised outcome

Ask for relevant experience, the actual team and a clear proposed role. Verify professional status through the appropriate official routes. A guarantee of winning, approval or a preferred conclusion is not evidence of stronger legal capability before the facts and applicable process have been assessed.

Do not assume that a UAE office or international brand establishes every form of representation. Ask who will perform advisory work and who would handle any proceedings, including additional counsel and fees where needed.

Sharing too much before acceptance

Provide the information counsel needs for conflicts and client-acceptance checks through suitable channels. Avoid distributing the full confidential matter file to many firms merely to seek preliminary quotations. Ask qualified counsel how substantive information should be handled once the relationship is established.

Do not assume that copying a lawyer automatically makes every communication privileged. Have counsel advise on confidentiality and privilege-related arrangements for the actual matter. Administrative convenience should not dictate broad circulation of sensitive advice.

Comparing fees without scope and authority

Separate matter phases, deliverables, staffing, expenses and assumptions. A low initial fee may cover only one review while another proposal includes negotiations or later support. Name the client contact who can approve additional work and consolidate business instructions. Ask counsel to flag conflicting instructions before proceeding so the authorised client owner can resolve them.

For example, several departments may send different contract positions to the firm. The lawyer needs an authorised route to resolve those instructions; procurement should not measure delay as a simple response failure while the business has not decided its own position.

Treating closure as a file download

Agree appropriate records, status information and transition support with qualified advice. Preserve open decisions and known timing concerns for any incoming counsel. Review service through clear advice, matter management and commercial discipline rather than win rates alone. These practices help the client obtain independent, useful legal support without pretending that a purchasing process can guarantee outcomes or replace professional judgment.
