Starting legal work with a bounded initial engagement

In brief

A bounded initial engagement can help a business assess a legal team's working style and obtain useful advice before committing to a wider scope. The phase should have a legitimate matter purpose, appropriate professional checks and a clear output. It should not be framed as a test that asks counsel to guarantee an outcome or provide substantial unpaid work.

Choose a decision-focused first phase

Define an initial assessment, document review or other task with the responsible legal professional. State the business objective, relevant facts and known timing concerns. Let counsel identify the information needed and advise on any urgent steps rather than forcing the matter into an artificial procurement timetable.

Complete appropriate conflicts, client-acceptance and professional-verification checks before substantive work. Identify the client entity and authorised instructions. A small initial fee does not remove the need for a proper engagement and suitable information handling.

Use the proposed delivery team

Confirm who performs the work, who reviews it and how the client will communicate with them. If a senior partner leads the first phase but another team would handle later work, make that transition explicit. The buyer needs to evaluate the relationship it may actually continue.

For example, an initial supplier-contract review can test whether counsel explains legal issues as clear decisions for the business. The client should assess usability and reasoning with appropriate legal input, not demand that the lawyer approve the commercial terms it already prefers.

Agree scope, fee and acceptance

Specify the deliverable, assumptions, review discussion and included iterations. Clarify what constitutes additional work and who may approve it. Ask how limitations and information gaps will be presented so the initial output does not imply more certainty than the evidence supports.

Use secure channels and obtain counsel's advice on appropriate confidentiality and privilege-related arrangements. Keep evaluation notes and administrative reporting proportionate; do not circulate substantive advice widely simply because the engagement is being assessed as a supplier trial.

Decide the next phase from evidence

Review whether the agreed work was delivered, the team communicated clearly and the client understands the next decisions. Ask for a revised scope reflecting the findings. Continue, change the team or seek another appropriate provider based on the matter's needs. A bounded appointment should produce useful professional advice and a reasoned next step, not an unsupported assumption that one successful initial task proves suitability for every future legal service.
